These Terms & Conditions (“Terms”) constitute an electronic record of the User agreement in accordance with the provisions of applicable laws, which applies to the user, of our Paw Parents website (“Website”), our Paw Parents applications (“Application”) or any products we offer or services in connection with the Application/Website(“Services”) and the user of our Services or visitors of this Website and/or Application, our listed sellers/ service providers (referred to as “User”/”you”/”your”).

We are Paw Parents India Private Limited, a company incorporated under the Companies Act, 2013 (herein referred as “Paw Parents”, “us”, “we”,” Company”, “Pawsome”) hereby specify These terms of usages of www.pawsomeindia.com and the Application which are made in accordance with the provisions of Rule 3 (1) of the Information Technology Act, 2000 (Guidelines for Intermediaries and Digital Media Ethics Code).

If you are using Paw Parent’s Website/Application/Services and the products we offer, we encourage you to kindly read the following terms and conditions associated with your usage of our website/application/services and products we offer.

Please read the Terms and the privacy policy of the Company (“Privacy Policy”) with respect to registration with us, the use of the Application, Website, Services, carefully before using the Application, Website, Services or products offered by us. In the event of any discrepancy between the Terms and any other policies with respect to the Application or Website or Services or products, the provisions of the Terms shall prevail.

Your use/access/browsing of the Application or Website or the Services through any means shall signify Your acceptance of the Terms and your agreement to be legally bound by the same.

If you do not agree with the Terms or the Privacy Policy, please do not use the Application or Website or avail the Services or products.

Permissible Age: These Terms constitute as a digital contract between you and Paw Parents. Therefore if you are not 18 years of age please refrain from using this Application and/or Website.

Account Registration Obligations

To access all features of our Application/Website, you shall be required to create an account. You must provide accurate, complete, and current information during the registration process. You are responsible for maintaining the confidentiality of your account credentials, including your username and password. Any activities that occur under your account will be your responsibility. You agree to provide accurate, current, and complete information and to update such information promptly if any changes occur. Providing false or misleading information may result in the suspension or termination of your account. If you create an account using a third-party service (such as Google or Facebook), you grant us access to certain information as permitted by you. With respect to the provision of information, the following may be noted:

• It is Your sole responsibility to ensure that the account information provided by You is accurate, complete, and latest.
• You shall be responsible for maintaining the confidentiality of the account information and for all activities that occur under Your account. You agree to (a) ensure that You successfully log out from Your account at the end of each session; and (b) immediately notify the Company of any unauthorized use of Your account. If there is reason to believe that there is likely to be a breach of security or misuse of Your account, we may request You to change the password or we may suspend Your account without any liability to the Company, for such period of time as we deem appropriate in the circumstances. We shall not be liable for any loss or damage arising from Your failure to comply with this provision.

Access to our Services/Application/Website through registrations/ are only for individuals above the age of 18 year(“Permissible Age”). If we attain the knowledge that you are younger than the Permissible age we may deactivate your account or make other restrictions on your usage of the Application/Website without any further notice to you. If you are using our Application / Website on behalf of someone under the Permissible Age, it shall mean that you have the authorisation to do so.

By registering your mobile number, you consent to being contacted via phone calls, email, SMS notifications, mobile apps, or other electronic communications such as order updates, shipment details, delivery information, and customer support.

Access Grant and User Restrictions

Paw Parents is an e-commerce platform which offers to sell certain products and/or services as listed in the Application/Website (“Services”) from time to time. We cater a platform through which consumers and sellers/service providers engages commercially (to buy goods/services). Paw Parents do not claim to be field experts or services providers or sellers or manufactures of any products offered in our Website and/or Application. Please read all the product/services description carefully before purchasing.

To the extent allowed by the Terms, Paw Parents grants you a personal, limited, non-exclusive, non-sublicensable, non-transferable and revocable license to access the Application/Website. The Services on the Application/Website are available to only selected locations in India. If you do not reside at such place, your usage of this Application/Website may be restricted or limited.

Any use of the Application, Website, Services or products or their contents other than for personal purposes is prohibited. Your personal and non-commercial use of this Application, Website, products and / or our Services shall be subjected to the following restrictions:

• 1. You shall not decompile, reverse engineer, or disassemble the contents of the Application and / or our Website and/or Services/ products or modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, extract the source code or object code of the Application and / or our Website and/or Services/products, or remove any copyright, trademark registration, or other proprietary notices from the contents of the Application and / or and / or our Website and/or Services/products.
  2. You will not (a) advertise or sell the Application/Website/Services or domain names or otherwise (whether or not for profit), or solicit claiming it to be your own (including, without limitation, solicitations for contributions or donations), or (b) use the Application and / or Website/our products and Services in any way that is unlawful, or harms the Company, the seller/service providers or any other person or entity concerned.
  3. No User shall be permitted to perform any of the following prohibited activities:
     1. Making available any content that is misleading, unlawful, harmful, threatening, abusive, tortious, defamatory, libelous, vulgar, obscene, child-pornographic, lewd, lascivious, profane, invasive of another's privacy, hateful, or racially, ethnically or otherwise morally objectionable;
     2. Stalking, intimidating and/or harassing another individual and/or inciting others to commit violence;
     3. Transmitting material that encourages anyone to commit a criminal offence, that results in civil liability or otherwise breaches any relevant laws, regulations, or code of practice;
     4. Interfering with any other person's use or enjoyment of the Application/Website/Services;
     5. Making, transmitting, or storing electronic copies of materials protected by copyright without the permission of the owner, committing any act that amounts to the infringement of intellectual property or making available any material that infringes any intellectual property rights or other proprietary rights of anyone else;
     6. Make available any content or material that you do not have a right to make available under any law or contractual or fiduciary relationship, unless You own or control the rights thereto or have received all necessary consents for such use of the content or material;
     7. Impersonate any person or entity, or falsely state or otherwise misrepresent Your affiliation with a person or entity; or provide false description or feedback or wrongfully list any products and/or services in our Application and/or Website;
     8. Post, transmit or make available any material that contains viruses, trojan horses, worms, spyware, time bombs, cancelbots, or other computer programming routines, code, files, or such other programs that may harm the Application/services, interests or rights of other users or limit the functionality of any computer software, hardware or telecommunications, or that may harvest or collect any data or personal information about other Users without their consent;
     9. Access or use the Application/Website/Services in any manner that could damage, disable, overburden, or impair any of the Application's/Website's servers or the networks connected to any of the servers on which the Application/Website is hosted;
     10. Intentionally or unintentionally interfere with or disrupt the Services or violate any applicable laws related to the access to or use of the Application/Website/Services, violate any requirements, procedures, policies, or regulations of networks connected to the Application/Website/Services/products, or engage in any activity prohibited by these Terms;
     11. Disrupt or interfere with the security of, or otherwise cause harm to, the Application/Website/Services, related materials, systems resources, or gain unauthorized access to user accounts, passwords, servers, or networks connected to or accessible through the Application/Website/Services/products or any affiliated or linked sites;
     12. Interfere with, or inhibit any User from using and enjoying access to the Application/Website/ Services/products, or other affiliated sites, or engage in disruptive attacks such as denial of service attack on the Application/Website/Services/products;
     13. Use deep-links, page-scrape, robot, spider or other automatic device, program, algorithm or methodology, or any similar or equivalent manual process, to increase or decrease traffic to the Application/Website/Services, or to access, acquire, copy or monitor any portion of the Application /Website/Services/products, or in any way reproduce or circumvent the navigational structure or presentation of the Application, or any content, to obtain or attempt to obtain any content, documents or information through any means not specifically made available through the Application/ Website/Services
     14. Alter or modify any part of the Services;
     15. Use the Services for purposes that are not permitted by: (i) these Terms; and (ii) any applicable law, regulation or generally accepted practices or guidelines in the relevant jurisdiction; or
     16. Any other manner violate any of the terms specified under the Terms for the use of the Application /Website/Services.

You understand and acknowledge that Paw Parents have no obligation to monitor your access to or use of the Application/Website/Services for violations of Terms, or to review or edit any content. Any and all liability arising out of or relating to violation of these Terms including in relation to the aforesaid information/ content/ message is your sole and absolute responsibility, and not of Company. If we find any User performing restricted acts specified in herein or commit any illegal activities in connection with the Website, Application, Services, we reserve the right to terminate their usage of this Website and Application, and/or take appropriate legal recourse against such users to the fullest extent permitted by applicable law.

The material on this Website/Application is provided for general information purposes only and should not be relied upon as the sole basis for making purchasing decisions. You acknowledge that it is your responsibility to verify any critical information before making a purchase. As an e-commerce website we provide a platform for customers to purchase goods/services from sellers and service providers. These product/services descriptions, shall be as provided by the seller and we in no way Company makes no warranties or representations whatsoever regarding the quality, content, completeness, or adequacy of such information and data.

Ownership of Intellectual Property:

Except as mentioned below, all information, content, material (tangible or intangible), trademarks, services marks, trade names, and trade secrets including but not limited to the software, text, images, graphics, video, script, and audio, contained in the Application, Website are proprietary property of the Company (“Proprietary Information”). No Proprietary Information may be copied, downloaded, decompiled, reverse engineered, reproduced, modified, republished, uploaded, posted, transmitted, or distributed in any way by anyone. Nothing on this Application or Website or Services shall be deemed to confer that a license of or any other right, interest, or title to or in any of the intellectual property rights aforementioned belonging to the Company, belongs to the User. You may own the medium on which the information, content or materials resides, but the Company shall at all times retain full and complete title to the information, content or materials and all intellectual property rights inserted by the Company on such medium. Certain contents on the Website may belong to third parties. Such contents have been reproduced after taking prior consent from said party and all rights relating to such content will remain with such third party. Further, you recognize and acknowledge that the ownership of all trademarks, copyright, logos, service marks and other intellectual property owned by any third party shall continue to vest with such party and you are not permitted to use the same without the consent of the respective third party.

All right, title and ownership with regards to the services and/or products we offer shall at all times vest will the registered service provider and/or seller of such services and/or product and we do not claim any ownership of any kind to such products. We do not manufacture or produce the materials we offer or make any alterations or modifications thereof. And as applicable, the respective service provides and/or sellers hereby agrees to indemnify the Company, its directors, agents, officers, employees, consultants against any and all claims, damages, demands, costs and expenses with respect to any claims associated with the products not limited to intellectual property infringement claims (such as patents, either in whole or in components )or any claim by any judicial, quasi-judicial, administrative body. The foregoing obligation shall be effective as of the first day the claim arises.

Limitation of Liability

In the preparation of the Application/Website/Services and contents therein, every effort has been made to offer the most current, correct, and clearly expressed information possible. Nevertheless, inadvertent errors may occur. In particular, but without limiting anything here, the Company disclaims any responsibility for any errors and accuracy of the information that may be contained in the Application. Any feedback from User is most welcome to make the Application and contents thereof error free and user friendly. You acknowledge that such information and materials may contain inaccuracies or errors and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law.

Our Website provides Users with access to varied products and services. We are not responsible for providing the services or manufacturing the products we offer. We disclaim all liability for any losses, damages, or disputes arising from your use of these third-party services and/or products. The products/services are being provided on an “as-is” basis and we assume no liability for the accuracy or completeness or use or non-obsolescence of such product/services. We shall not be liable to update or ensure continuity of such information contained on the Website. We would not be responsible for any errors, which might appear in such information, which is compiled from our suppliers or for any unavailability of such information.

From time to time the Website may also include links to other websites. These links are provided for your convenience to provide further information. They do not signify that we endorse the website(s). We have no responsibility for the content of the linked website(s). Please read the terms and conditions of such websites before entering.

To the fullest extent permissible under applicable law, Company shall not be liable for any actions or inactions of the Users or our delivery partners or our service providers not limited to damage to tangible property, medical negligence, fraud, misappropriation, death or bodily harm. Further notwithstanding anything contained to the contrary and to the extent permitted by applicable laws, in no event shall the Company, its officers, directors, employees, partners, or agents be liable to You or any third party for any special, incidental, indirect, consequential, or punitive damages whatsoever, including those resulting from loss of use, data or profits or any other claim arising out, of or in connection with, Your use of, or access to, the Application/Website/Services.

Commercial Terms & Conditions

All orders placed by users on the Website/Application constitute an offer to purchase; the final acceptance rests with the seller/service provider. Company reserves the right to accept or reject any order without providing a reason. Order placed notification is acknowledgment of order receipt, not acceptance. Order confirmation is subject to successful payment authorization. Subject to payment verification a confirmation email/ push notification/SMS of acceptance is sent it will be considered as order accepted, except for cash of delivery, where receipt of product/service payment will be considered as acceptance.

Further stock availability or availability of service provider will be taken into consideration before an order is confirmed. If a product is out of stock or a service is unavailable, customer will be notified promptly, if payment is already made, refund may be offered. Order processing time may take 3 to 24 hours depending on the circumstances. Once an order is confirmed by us, any modifications (such as product, quantity, delivery address) may not be allowed.

Orders may be cancelled by us, at any time due to:

Customers will be provided with tracking information once order is dispatched. We are not liable for delays caused by third-party logistics providers, service providers, delivery agents. If a delivery fails due to customer unavailability a second attempt may be made.

Exchanges, Shipping Fees & Delivery

• The item received is defective, damaged, expired or incorrect; and
• The item is eligible for exchange must be unused, and in its original packaging with all accessories included; and
• An exchange request is submitted within [3] days of delivery.

After we receive and inspect the returned item, we process the exchange request. The correct item will then be shipped to the registered address of your returned order. Except for the foregoing, any returns, refunds and exchanges are not permissible.

1. Shipping: We offer shipping within Bengaluru, Karnataka, India. You have to specify the address to which the shipment has to be made at the time of purchase. All product(s) shall be delivered directly to the address as specified at the point of ordering and You cannot, under any circumstances whatsoever, change the address after the order is processed. In case of any change in the address, you need to specify the same to us in writing well in advance to the dispatch date. Any inconsistencies in name or address will result in non-delivery of the product(s). Orders are processed within [3] business days or any other time period shown under the item(s) ordered. Shipping costs are calculated at checkout and depends on the destination and order size. We are not responsible for shipping delays caused by external factors, such as customs processing, carrier issues, or natural disasters. Once an order has been shipped, you will receive a tracking number via email.

1. Delivery: Orders will be delivered to the shipping address provided during checkout. Please ensure the accuracy of your shipping details, as we are not responsible for orders shipped to incorrect addresses. If an order is lost or significantly delayed, please contact our support team within 24 hours for assistance.

Order or Booking Cancellation

If an order has been processed or shipped or a services has been booked it cannot be cancelled by you. You may be permitted to cancel an order or a booking within a prescribed time which will be enlisted under your order details. We are not under obligation to provide you an option to cancel your order or booking. Please read the specific conditions of an order or appointment/consultation/services before ordering or booking.

We reserves the right to cancel orders under the following circumstances: (a) if there is suspicion of a fraudulent transaction by the user, (b) if the transaction appears to violate these Terms, (c) due to product or service unavailability, or (d) due to reasons beyond our control, including logistical challenges related to delivery. For such cancellations, subject to the order terms and conditions, we may initiate any applicable refunds for the relevant product or service within approximately 2 to 7 business days.

We reserve the right to deny access to non-complying users / users that appear to be involved in fraudulent transactions at any time or cancel any orders placed by them in future.

Offers and Promotions

We may, at times provide certain offers on the products and services offered, these offers will be limited to (a) specific user groups e.g., first-time buyers, loyalty members, subscribers; (b) certain products, brands, categories of services only; (c) minimum order value may be required to quality; these offers will be listed in our Application and/or Website itself and each offer will have a clearly defined start and end date/time and expired offers will not be honoured under any circumstances. We reserve the right to change the offer nature, validity without any prior notice.

Further we may provide certain promotional coupons which will be valid for one-time use only per User and per transaction. These promotional coupons cannot be transferred or exchanged for cash or credit. Promotional coupons or offers may not be combined with other ongoing deals unless explicitly stated. Conditions on how to avail the offers or promotional coupons will be stated in the description section of such offers and/or promotional offers.

Company is not obligated to honour incorrect promotional prices due to technical or typographical errors. Orders placed with mispriced promotions may be cancelled or revised without prior notice.

Delivery Agents or Individual Service Providers

We facilitate your order delivery through independent contractors, who operate on a principal-to-principal basis. These delivery partners are not our employees or agents but function as independent service providers. They are not exclusively bound to provide delivery services at any given time. There is no principal-agent relationship between us and the delivery partners. Accordingly, the platform is not liable for any acts or omissions of the delivery partners.

Certain services such as dog walking, pet sitting, pet grooming etc., offered through our Website/Application will be performed by such individuals who are not our employees or agents but function as independent service providers.. We are not liable for any of their acts or omissions of our Delivery Agents/Service Providers.

You are expected to respect the dignity and diversity of Delivery Agents/Service Providers and contribute to a secure and harassment-free work environment. Any form of harassment, including sexual harassment, will not be tolerated. Paw Parents reserves the right to restrict or revoke access at its absolute discretion if a customer behaves in a manner that is discourteous, disrespectful, abusive, or otherwise inappropriate or unlawful towards a Delivery Agents or Service Providers. Customers must treat Delivery Agents or Service Providers with courtesy and respect at all times. Further, any consequences arising from inappropriate behaviour, including claims or compensation demanded by a Delivery Agents or Service Providers., shall not be on our account. You are advised to take appropriate legal recourse against the perpetrator.

Third-Party Services

Our Application/Website may integrate, link to, or rely on third-party services, including but not limited to payment processors, shipping and logistics providers, service providers, marketing platforms, analytics services, and authentication providers. By availing such third party services you hereby give your exclusive consent to share your personal information as available with us along with all order details, with the third party service provider to prove such services. Your use of these services is subject to their respective terms and policies, and we do not control any aspect of these services or assume responsibility for their actions, security, or data handling practices.

Advertising

We may display advertisements on our platform, including third-party advertisements. The presence of such advertisements does not imply an endorsement or guarantee of the products or services being advertised. We are not responsible for the content, accuracy, or legality of advertisements displayed on our platform. Any interactions, transactions, or disputes arising from such advertisements are solely between the User and the advertiser. Please read all terms and conditions carefully before engaging with the listed advertisers.

Some links on our Website and/or Application may be affiliate links, meaning we may earn a commission if you make a purchase through them. Sponsored content or advertisements may also appear on our Website and/or Application, and we are not responsible for the claims or representations made by these third-party advertisements.

We may from time to time provide space in our Application/Website certain campaigns, contests, lucky draws. Participation in such campaigns, accessing any embedded third-party links, scanning codes, and/or availing services pursuant to such campaigns shall be at your own risk and shall additionally be governed by the terms and conditions of the campaigns and those of the relevant brands, advertisers, or sponsors. We do not provide representation or warranty of any kind, whether express or implied, with respect to the campaigns (including contests or contest rewards). The brand, advertiser, or sponsor shall be solely responsible for their fulfilment.

We reserve the right to remove or modify advertisements at our discretion without prior notice. Users are prohibited from engaging in any fraudulent, misleading, or deceptive advertising practices while using our platform.

Applicable Taxes, Shipping Fees etc.

All purchases made through the Website/Application are subject to applicable taxes, including but not limited to Goods and Services Tax (GST) and any other levies as per prevailing laws in India. The final price displayed at checkout includes applicable taxes unless stated otherwise. The responsibility for remitting applicable taxes to the relevant authorities lies with the seller of any product or service, where required by law.

In cases where tax collection at source (TCS) or tax deducted at source (TDS) is applicable, it shall be deducted in accordance with the relevant provisions of the Income Tax Act, 1961, or any other applicable law. Any additional customs duties, import taxes, or other charges levied by regulatory authorities shall be borne by the buyer.

The User expressly grants such permission to contact him/her through telephone, SMS, e-mail and holds the Company (including but not limited to its subsidiaries/affiliates) indemnified against any liabilities including financial penalties, damages, expenses in case the User's mobile number is registered with Do not Call (DNC) database. By registering yourself in our Application/Website, you agree to make your contact details available to Our employees, associates, subsidiaries, affiliates, and partners so that you may be contacted for service completion, education information, offerings and promotions through telephone, SMS, email etc.

Upon registration through any means whatsoever, the Company may contact You through the registered mobile number or e-mail or any other mobile number or contact number or email provided by You to enable effective provision of Services. The User expressly permits the Company to contact him/her or the individual utilising the Services, through the above-mentioned means at any time post registration. Further, the Company shall have the right to monitor the usage of the Application/Services/Website by the User, to analyse such usage and discuss the same with the User to enable effective and efficient usage of the Services.

We respect your privacy and are committed to protecting your personal data. Any information collected during transactions or interactions with our website is used solely to process orders, improve our services, and communicate with customers. We do not sell, trade, or share your information with third parties except as necessary for order fulfilment and legal compliance. Indemnity

You agree to defend, indemnify and hold harmless the Company, its officers, directors, employees and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to reasonable attorney's fees) arising from: (i) Your use of and access of the Application/Website/Services; (ii) Your violation of any term of these Terms or any other policy of the Company; (iii) Your violation of any third party right, including without limitation, any copyright, property, or privacy right; or (iv) any claim that Your use of the Application/Website/Services has intervened any third party’s rights. This defence and indemnification obligation will survive indefinitely to the extent allowed by law.

Equitable Relief

In the event of Your breach of these Terms, you agree that the Company will be irreparably harmed and may not have an adequate remedy in money or damages. The Company therefore, shall be entitled in such event to obtain an injunction against such a breach from any court of competent jurisdiction. The Company's right to obtain such relief shall not limit its right to obtain other remedies.

Dispute Resolution

You agree that the Terms are governed by the laws of India and any dispute will be resolved in accordance with the laws of India. Any action or proceeding brought to enforce the terms of this Terms or to adjudicate any dispute must be brought in the Bangalore, Karnataka. You agree to the exclusive jurisdiction and venue of these courts. You waive any claim of inconvenient forum and hereby accede to and accept the jurisdiction of such courts.

If Paw Parents has a dispute with You, Paw Parents shall send our Notice of Dispute to your registered email address and/or any billing address You have provided us.

Disclaimers

You acknowledge that the Company is not the manufacturer or service provider of the services/products/consumable goods and hence, any defect relating to the same shall be reported to the manufacturer whose details shall be specified on the product/services details and the Company shall not be in any manner responsible for the same. The Company does not provide any guarantee or warranty relating to the services/products/consumable goods.

You acknowledge that Your ability to use Your account is dependent upon external factors such as internet service providers and internet network availability and the Company cannot always guarantee accessibility to the Application. In addition to the disclaimers set forth in the Terms, the Company shall not be liable to You for any damages arising from Your inability to log into Your account and access the services of the Application at any time.

You agree to provide accurate, complete, and up-to-date billing details. Failure to do so may result in delays or cancellation of your order. If we suspect fraudulent activity, we reserve the right to refuse or cancel an order and may request additional verification before processing payment.

In the event a minor utilizes the Application/Website/Services, it is assumed that he/she zas obtained the consent of the legal guardian or parents and such use is made available under the guidance of their legal guardian or parents. The Company will not be responsible for any consequence that arises as a result of misuse of any kind of Our Application/Website or any of any products or Services that may occur by virtue of any person including a minor registering for the Services/products provided. You acknowledge that the Company does not have the responsibility to ensure that You conform to the aforesaid eligibility criteria. It shall be Your sole responsibility to ensure that You meet the required qualification.

Any violation by You of the terms of this Clause may result in immediate suspension or termination of Your Accounts apart from any legal remedy that the Company can avail. In such instances, the Company may also disclose Your Account Information if required by any Governmental or legal authority. You understand that the violation of these Terms may also result in civil or criminal liability under applicable laws.

Termination

We reserve the right to suspend or terminate your registration or your access to our Application/Website/Services, at our sole discretion, without prior notice or liability, if we determine that you are not of Permissible Age or do not have the authorisation to act on behalf of any individual who is not of Permissible Age, any applicable law, or engaged in fraudulent, abusive, or unlawful activity or act in any way inconsistent with the provisions of User restrictions under these Terms or breach any User obligations under the Terms.
